Retention of Title Clause

The transfer of ownership occurs upon full payment of the price by the customer, in accordance with Article 2367 of the Civil Code. In the event of non-payment, even partial, according to the agreed terms and conditions, we (or the carrier mandated for this purpose) are entitled to exercise the right of claim over the sold products, in the customer's possession.

Delivery

Delivery is made from our warehouses. If the products are transported to another delivery location specified by the buyer, delivery times are indicative. We do our utmost to ensure that your purchases are delivered as quickly as possible. Due to logistical constraints, these times are indicative and do not bind the responsibility of GROS FRERE & SOEUR SAS, except for special conditions directly agreed upon for the conclusion of the sale. Customers are responsible for the accuracy of the delivery address provided before order validation.

After-Sales Service

Any reservations must be mentioned on the delivery note and by separate mail to the carrier within the strict deadline of 3 days, by registered letter with acknowledgment of receipt. The customer's signature on the delivery note without reservations implies conformity with the order.

Right of Withdrawal

In accordance with distance selling regulations, non-professional consumer customers have a 14-day right of withdrawal from the date of receipt of the products, and in the case of sales by lots, from the receipt of the last lot. Exclusion: The right of withdrawal, in accordance with Article L221-28 of the Consumer Code, does not apply to sales of futures. If you are eligible, your withdrawal must be notified to us directly by mail, to the address listed on the order confirmation and/or delivery note.

Return Costs

The direct costs are your responsibility. If you exercise your right of withdrawal under legal conditions and the products are received in their original condition, the refund will be made within the legal period of 14 days from their receipt.

Warranties

Our sales are eligible for the legal warranty against hidden defects for a period of 2 years (Articles 1641 et seq. of the Civil Code) and the conformity warranty (Article 217-4 of the Consumer Code) under the legal conditions.

Risks - Risk Insurance

The products are transported at the buyer's risk if they are a professional; SAS GROS FRERE & SOEUR is insured for its activity.

Applicable Law

These general conditions are subject to French law, regardless of the territorial jurisdiction of the buyer.

Disputes

We favor the amicable resolution of disputes: any dispute, before being brought to court, will be notified by the customer so that a non-contentious solution can be sought, by mutual agreement between the parties. If despite our efforts, a difficulty persists between the parties 60 days after the notification of the dispute, each party will resume its right to refer the matter to the competent court. Consumer customers may resort to the Consumer Ombudsman (Article L211-3 of the Consumer Code).
